This STB judgment is likely to attract attention, because cats. But there's a more interesting point that may fly under the radar.
One of the issues that came up was whether the tennis courts in the condominium could be used for commercial coaching. The MCST took the position that since the by-laws did not expressly prohibit commercial coaching, it was therefore allowed.
However, the coram took the view that since the condominium was a purely residential development without commercial lots, a by-law would need to be passed for such commercial coaching to be allowed.
As such, purely residential condominiums may need to consider passing similar by-laws to, for example, allow swimming coaches to conduct swimming lessons in the condominium pool!
